Defective product claims can be made based on a breach of duty of care, breach of contract or under the Australian Consumer Law. These types of claims can cover anything from a house burning down because of a faulty mobile phone battery to an illness or injury caused by a contaminated batch of medication.
Claim Against Offshore Manufacturers and Importers
The Australian Consumer Law imposes statutory guarantees on the suppliers of good and services to consumers. It allows claims to be made against the importer of a defective product if the manufacturer is overseas.
